Effective January 2018, Pursuant to Penal Code Section 29810, defendants convicted of a felony and certain misdemeanor offenses are required to relinquish all firearms in their possession and/or control. The Court provides the defendant with the Prohibited Persons Relinquishment (PPR) Form at the time of conviction, which informs the defendant about their obligation to comply with the law. The court then refers the matter to the Probation Department to conduct an investigation, which includes accessing various automated systems, for example, the Department of Justice (DOJ) Automated Firearms System, to determine if the defendant has complied with the law. Probation informs the court of the investigation outcome: defendant surrendered the firearm to law enforcement; defendant sold the firearm to a licensed firearms dealer; defendant transferred to a firearm to a licensed firearm dealer; or firearm was confiscated by Probation during a search.
